PAPER LAID REPORT ON CONSIDERATION OF THE CREATIVE ECONOMY SUPPORT BILL (SENATE BILL NO.30 OF 2024)

NOTICE OF MOTION

PROVISION OF IFMIS REPORTS FOR COUNTY GOVERNMENTS TO THE SENATE

THAT, AWARE that, Article 96 of the Constitution provides that the Senate represents the counties, and serves to protect their interests, determines the allocation of national revenue among counties, as provided in Article 217, and exercises oversight over national revenue allocated to the County Governments; FURTHER AWARE THAT, in the case of The Senate, the Council of Governors and 6 others Petition No. 24 and 27 of 2029 (consolidated) 2022 KESC No. 57(KLR), the Supreme Court affirmed that the Senate’s oversight authority extents to both nationally allocated and locally generated revenue; CONCERNED THAT, that Senators are constrained by lack of access to real time to data from the IFMIS system for the respective counties they represent, thus affecting effective oversight of County Governments; FURTHER CONCERNED THAT, in some instances data and information presented to the Senate by the Auditor-General and the Controller of Budget are received and considered late as a result of the backlog resulting into too much information not getting properly reviewed by Senators; NOTING THAT, as a result of unchecked financial information and systems, County Governments have continued to accumulate pending bills resulting from unplanned expenditures, unaccounted for and inflated cost of projects; NOW THEREFORE, the Senate resolves, that the Cabinet Secretary in charge of the National Treasury shall on a monthly basis forward to the Clerk of the Senate all IFMIS transactions and reports for each County Government for onward transmission to the respective Senator for information on accountability and transparency, in order to strengthen their constitutional oversight and promote good governance in the management of public finances.

POSTPARTUM DEATH OF MS. ROSE WANGARI MAINA

1. An account of the circumstances leading to the death of Ms. Rose Wangari Maina, including the specific complications she developed, the nature of emergency care provided and the clinical decision made during her hospitalization.

Mr. Speaker, Sir, if you could protect me, there is so much noise in the House. I cannot hear myself.

1. Whether the medical personnel and management at both Kayole 2 Level 4 Hospital and Abyan Hospital adhered to established emergency protocols, and if there were any instances of negligence or misconduct.
2. The general state of service delivery at Kayole 2 Level 4 Hospital with particular reference to the condition of the maternity wards and allegation of unsanitary and substandard facilities.
3. The policy measures and interventions currently being undertaken by the Ministry of Health to reduce maternal mortality during and after childbirth and ensure that childbearing is safe, dignified, and not a cause of fear among women.

COMMUNICATION FROM THE CHAIR

DISPOSAL OF H.E THE PRESIDENT'S MEMORANDUM ON THE CONFLICT OF INTEREST BILL, (NATIONAL ASSEMBLY BILLS NO.12 OF 2023)

The Speaker (Hon. Kingi); Hon. Senators, before we go to Orders No.9, 10, 11 and 12, I have a Communication to make in relation to Order No.12; the disposal of His Excellency the President's Memorandum on the Conflict of Interest Bill, National Assembly Bills No.12 of

1. As you are aware, the Conflict of Interest Bill (National Assembly Bills No.12 of 2023) was published vide Kenya Gazette Supplement No.41 of 2023 as a Bill seeking to provide for the management and regulation of conflict of interest in the discharge of official duties. The National Assembly passed the Bill on the 6th December, 2023 and referred it to the Senate for consideration. The Bill was read a First Time in the Senate on 14th February, 2024 and subsequently passed it with amendments on 16th May, 2024 and referred back to the National Assembly. The National Assembly did not concur with the Senate amendments to the Bill and voted to reject the said amendments on 24th July, 2024. The Bill was subsequently referred to a Mediation Committee in accordance with Article 113 of the Constitution and Standing Orders of the Houses of Parliament. On 5th December, 2024, the Report of the Mediation Committee was tabled in the National Assembly and the Senate. The National Assembly approved the mediated version of the Bill on the 5th December, 2024, while the Senate approved the mediated version of the Bill on 8th April, 2025. Following the approval of the mediated version of the Bill by the Houses of Parliament, the Bill was presented to His Excellency the President for assent. Hon. Senators, on 30th April, 2025, His Excellency the President referred the Conflict of Interest Bill (National Assembly Bill No.12 of 2023) back to Parliament for reconsideration in accordance with the provisions of Article 115 of the Constitution.

On 6th May, 2025, I conveyed a Message to the Senate from the President on the Memorandum and committed the matter to the Standing Committee on Justice, Legal Affairs and Human Rights for consideration. Similar procedures in accordance with the relevant Standing Orders were being followed in the National Assembly.

Consequently, the National Assembly considered the President's reservations and passed the Bill fully, accommodating the President's reservations on Tuesday, 3rd June, 2025.

By way of a Message, I communicated this decision of the National Assembly to the assembled Senate on 5th June, 2025. On the part of the Senate, the Standing Committee on Justice, Legal Affairs and Human Rights tabled its Report on the President's Reservations on 12th June, 2025.

At the sittings of the Senate held on Wednesday, 9th and on Thursday, 10th July, 2025, the Senate, through the Committee of the Whole, considered the President's Reservations. In accordance with established procedure in a Committee of the Whole, the Chairperson of the Committee deferred the putting of the questions to a later date. Upon resumption of interrupted

1. Pursuant to Article 115(2) of the Constitution, amend the Bill in light of the President's reservations or amend the Bill in a manner that fully accommodates the President's reservations. This will require the vote of a majority of the delegations in the Senate, which is 24 delegations, or;
2. Pursuant to Article 115(4) of the Constitution, pass the Bill a second time without amendment or with amendments that do not fully accommodate the President's reservations. This will require the vote of two-thirds of the delegations in the Senate, which is 32 delegations. Now, from the foregoing, the only action that will take the agenda forward is either an acceptance or a rejection of the President's reservations by the requisite numbers. For the avoidance of doubt, the Committee of the Whole will vote on each reservation. It would appear that any other action that does not result in an outright acceptance or rejection of the President's reservations would put the Bill in a position of uncertainty to which former Speaker Ekwee Ethuro referred to as constitutional purgatory. I refer Hon. Senators to Standing Order No.170(5), which gives a window to the Speaker to direct a further vote to be taken on a question within five sitting days. Whenever a question to approve or reject the President's reservation fails to obtain the required majority and the vote results in a majority of the “Ayes” and the “Nays” have not numbered at least one third of all Senators. Standing Order No.170(6), however, states that if the Speaker does not direct a further vote under Paragraph 5, or if on such further vote the fixed majority is not obtained to either reject or approve, the Speaker shall declare that the Motion is negative. 3. Whether the Independent Policing Oversight Authority (IPOA) has initiated investigation into police operations during the saba saba protests, specifically the killing of innocent Kenyans and the use of brutal force against unarmed protesters to ensure that those responsible are held accountable.
4. Recommendation for reforms to ensure transparency, accountability and respect of human rights in crowd control and detention procedures, including whether enforcement officers receive sufficient training on lawful conduct and ethical standards in line with their duties and the system in place to hold them accountable for misconduct. UTILISATION OF CLIMATE FINANCING AND DEVELOPMENT GRANTS IN WAJIR COUNTY

1. Utilization of the capital grants and transfers by Wajir County, including source of funding, total amount received, funded projects, the allocations and awards and current implementation status;
2. Provide a list of infrastructure and civil works projects implemented by the County, including project names, locations, and progress updates;
3. A ward-by-ward breakdown of projects financed through the Climate Change Adaptation Fund, including the project names, amounts allocated and implementation status.

STATUS OF CRITICAL MEDICAL EQUIPMENT AT BARAGOI SUB-COUNTY HOSPITAL

1. Reasons behind the delay in servicing and repairing and the anesthesia and X- ray machines and establish who is responsible for this prolonged inaction.
2. Plans by the county and national governments to equip Baragoi Sub-County Hospital with a CT scan machine.
3. The expected timelines for procurement of a haemogram machine to improve the hospital’s surgical and diagnostic capacity.
4. The interventions to ensure the hospital operates at full capacity and can adequately safeguard the health and wellbeing of residents in Samburu North Sub-County and the county at large.

STATE OF EARLY CHILDHOOD DEVELOPMENT EDUCATION IN KIRINYAGA COUNTY

1. The number of ECDE centres in Kirinyaga County, including the number of permanent and semi-permanent classrooms as well as existing classrooms shortage.
2. Status of implementation of ECDE teachers’ scheme of service by the County Government of Kirinyaga;
3. The current teacher-pupil ratio and whether there is a shortage of ECDE teachers; and,

RESURGENCE OF A CULT-LIKE ACTIVITIES IN BINZARO VILLAGE, KILIFI COUNTY

The Senate Minority Leader (Sen. Madzayo): Thank you, Mr. Temporary Speaker, Sir. I rise pursuant to Standing Order No.53(1) to request for a Statement from the Standing Committee on National Security, Defense and Foreign Relations regarding the resurgence of a cult-like activity in Binzaro village of Chakama in Shakahola, Kilifi County, nearly two years after the massacre.

Mr. Temporary Speaker, Sir, in the Statement, the Committee should-

1. Investigate the circumstances that led to the mysterious death of at least three individuals in a suspected case of religious radicalisation in the Binzaro village of Chakama, close to Shakahola in Kilifi County;
2. Find out why there was colossal failure by the Government to protect the survivors of the Shakahola massacre from regrouping and continuing indoctrination in Binzaro village which is a few kilometres from Shakahola;
3. Disclose a detailed breakdown of the total number of the survivors of the Shakahola massacre, including minors and the steps taken to rehabilitate, reintegrate and support them to prevent them from regrouping;
4. Provide the current status of the criminal investigations and legal proceedings against individuals implicated in the Shakahola tragedy to deter the religious extremist leaders from indoctrinating the public or the citizens of Kilifi County;
5. Provide the timeline for releasing of the Shakahola victims' bodies to their families along with the cause of the delays; and,
6. Finally, the Committee should recommend the long-term measures the Ministry of Interior and Coordination of National Government should take to protect the communities from religious exploitation, particularly in the remote parts of Shakahola and the vulnerable areas.
