STATEMENTS

DELAYED TRANSFER OF AMBOSELI NATIONAL PARK MANAGEMENT TO KAJIADO COUNTY GOVERNMENT

Mr. Speaker, Sir, I rise pursuant to Standing Order No.53(1) to seek a statement from the Standing Committee on Land, Environment and Natural Resources on a matter of national concern regarding the delayed transfer of Amboseli National Park Management to the Kajiado County Government.

Mr. Speaker, Sir, in November, 2025, a Presidential Proclamation directed the transfer of Amboseli National Park to the Kajiado County Government and all legal processes to entrench the transfer were subsequently completed. However, despite this, the county government has been unable to assume full control of the facility because the Kenya Wildlife Service (KWS) has failed to hand over operations. This impasse has not only undermined the validity of the Presidential Proclamation and the legal process undertaken, but has led to reported harassment of county staff by KWS officers thereby frustrating the transition.

In the statement, the committee should address the following-

1. (1) The current status of the Amboseli National Park, categorically stating whether it has officially been transferred to the County Government of Kajiado or not.
2. (2) The timeline and measures in place to ensure that the functions and operations of the park are formally handed over to the County Government of Kajiado by the Kenya Wildlife Service.
3. (3) The assurances that harassment of county staff by KWS officers will cease immediately to allow for a smooth transition and effective management of the park by the devolved unit.

STALLED BACHELOR OF ARTS IN HOSPITALITY COURSE AT THE UNIVERSITY OF NAIROBI

Mr. Speaker, Sir, I rise, pursuant to Standing Order No.53(1) to seek a statement from the Standing Committee on Education on a matter of nationwide concern namely, the stalled Bachelor of Arts in Hospitality Course at the University of Nairobi.

Mr. Speaker, Sir, this course was previously offered by the university in collaboration with the Kenya Utalii College, but has remained in limbo since 2024, following the expiry of the collaboration agreement between the University of Nairobi and the Kenya Utalii College. However, students enrolled in the programme who have remained at home for over two years are yet to receive any explanation or a remedy to their predicament. Many have now exceeded the anticipated graduation dates by at least three years.

In the statement, the committee should address the following-

1. (1) The reasons that led to the stalling of the Bachelor of Arts in Hospitality Course at the University of Nairobi, Nairobi's Kenya Utalii College unit.

1. (2) Timelines for when the affected students can expect to resume their studies or otherwise receive a definite resolution to the matter.

EVICTION OF TENANTS FROM NATIONAL HOUSING ESTATE IN CHANGAMWE WARD

MATATU OPERATORS’ BOYCOTT AT MACHAKOS BUS PARK

1. (1) The circumstances surrounding the allocation of the 67 parking bays at the Machakos Bus Park, including the criteria used to allocate the bays among the 47 PSV SACCOs.
2. (2) Whether due process, stakeholder consultations, transparency and public participation were observed during the allocation process.
3. (3) The measures the County Government of Machakos has taken to resolve the dispute, restore normal transport services and protect the interests of commuters and the transporters.
4. (4) The plan by the county government to address the congestion at the Machakos Bus Park and improve public transport infrastructure to meet the growing demands for PSV services.

MAINSTREAMING OF WOMEN IN NATIONAL SECURITY GOVERNANCE

1. (1) Women participation highlighting efforts to integrate women in decision- making roles within national and county security advisory framework.
2. (2) Sustainable funding outlining mechanisms for continuous financing and coordination of peace monitoring systems beyond election circles.
3. (3) Gender-responsive approaches detailing measures to embed gender-sensitive strategies in conflict prevention and early warning systems.
4. (4) Activation of peace monitors clarifying the extent to which national and county-level peace monitors have been institutionalized and linked to formal security structures.
5. (5) Assessment of government facilitation of community leaders, including women and youth in peace building and integration of grassroots early warning systems into national security strategy.

PERSISTENT TECHNICAL GLITCHES IN HEALTHCARE DIGITAL SYSTEMS

Mr. Speaker, Sir, protect me from these interruptions.

1. (1) The long-term measures being implemented to resolve the persistent technical glitches affecting healthcare digital systems in the public hospitals across the country.
2. (2) The alternative mechanisms available to patients when healthcare digital systems fail, including manual processing protocols and the support measures in place to ensure that patients are not denied care or subjected to unexpected out-of-pocket expenses.
3. (3) The plans to conduct a comprehensive audit of healthcare digital systems in public hospitals across the country to identify vulnerabilities and assess their resilience.

1. (4) The specific information, digital systems and technologies currently used in public hospitals to manage patient eligibility, claims processing and hospital reimbursements and provide the total number of reported cases of system failure over the past 12 months resulting in delayed or denied patient care.
2. (5) The concrete measures being taken to prevent future system outages, strengthen the reliability of healthcare digital infrastructure and safeguard the uninterrupted delivery of patient care.

EFFECTS OF UNSUSTAINABLE SAND HARVESTING ON RIVER ECOSYSTEMS IN KITUI COUNTY

Mr. Speaker, Sir, I rise pursuant to Standing Orders No.53(1) to seek a Statement from the Standing Committee on Land, Environment and Natural Resources on a matter of county-wide concern---

Mr. Speaker, Sir, it appears like I am reading this Statement to myself. The Majority Leader, the Minority Whip, the Majority Whip and the Speaker---

1. (1) The measures taken by the National Environment Management Authority (NEMA) to regulate sand harvesting in the county, including licensing, compliance, monitoring and enforcement action against persons or entities engaged in illegal or environmentally harmful activities from the year 2020 to date.
2. (2) The restoration and rehabilitation programmes being implemented in the affected areas, including riverbank stabilisation, restoration of riparian vegetation, rehabilitation of degraded sites and catchment conservation.
3. (3) The budgetary resources allocated and already expended on the restoration of degraded river ecosystems in Kitui County from Financial Year 2021/2022 to date.
4. (4) The findings of any scientific assessments undertaken by NEMA - and I underline the word NEMA - on the cumulative environmental impact of sand harvesting in Kitui County and the long-term measures put in place to designate sustainable sand harvesting zones and protect ecologically sensitive sections of rivers.

Mr. Speaker, Sir, on this statement, I would like to make a request. A few months ago, I raised a similar statement on the degradation of rivers and this is on the NEMA action to deal with that degradation. I therefore request your office to direct the Committee on Land, Environment and Natural Resources to visit these rivers in Kitui before we convert the entire county into a desert while we are just reading statements on the Floor of the Senate.

UTILISATION OF COUNTY SPORTS FACILITIES IN KISUMU COUNTY

1. (1) The measures undertaken by the County Government of Kisumu to ensure sports facilities serve as centres for structured talent identification and development.

1. (2) The interventions implemented to promote equitable access to sports facilities by schools, community clubs, women, Persons with Disabilities (PwDs) and other groups.
2. (3) The strategies to leverage sports infrastructure for tourism, investment and economic growth.
3. (4) The partnerships established with sports federations, educational institutions and the private sector to maximize utilization and sustainability of county sports facilities.

STATE OF ELECTRICITY CONNECTIVITY IN MARSABIT COUNTY

Mr. Speaker, Sir, I rise pursuant to Standing Orders No.53(1) to seek a statement from the Standing Committee on Energy on a matter of county-wide concern regarding the state of electricity connectivity in Sessi, Moyale Constituency and in Leyai, Lpus, Lturuyia and Lkilanga areas of Songa as well as other unserved parts of the county. The committee should address the following concerns:

1. (1) The current state of electricity connectivity and infrastructure in Sessi, Leyai, Lpuz, Lturuyia and Lkilanga, including the specific areas without transformers.
2. (2) The reason why Sessi, Leyai and Lpuz areas have not been provided with transformers despite ongoing rural electrification and last-mile connectivity programmes.
3. (3) Whether there are any approved ongoing or planned projects by the Ministry of Energy and Petroleum, Rural Electrification and Renewable Energy Corporation (REREC) and Kenya Power (KP) targeting these areas and if so, provide the implementation timelines.
4. (3) The state of electricity connectivity across Marsabit County specifying all locations that remain unconnected or underserved and outlining the Government's ongoing and planned interventions to achieve full and reliable connectivity which will target associated budget and implementation timelines.

BOUNDARY DISPUTE AT ARBJAHAN ALONG MARSABIT–WAJIR COUNTIES

Mr. Speaker, Sir, I rise pursuant to Standing Order No.53(1) to seek a statement from the Standing Committee on National Security, Defence and Foreign Relations on a

matter of inter-county concern regarding the ongoing border disputes and rising tensions at Arbjahan along the Marsabit-Wajir County boundary.

Recent reports of encroachment into areas traditionally recognised as part of Marsabit County and establishment of settlement and public infrastructure within the disputed area have highlighted tensions and if left unaddressed, the situation risks escalating into violent conflict. Displacement of residents will occur, destruction of property and disruption of long-standing peaceful coexistence between these communities.

In the statement, the committee should address the following:

1. (1) The circumstances surrounding the ongoing tensions at Arbjahan, including the investigations undertaken by the Ministry of Interior and National Administration, to ascertain the---

Also, they should tell us the measures being taken to prevent escalation through security interventions, peace-building efforts and protection of residents and property.
2. (2) The long-term interventions aimed at restoring calm, safeguarding lives and property, upholding the integrity of establishment or administrative boundaries and promoting strategies for sustainable peace and stability.
3. (3) Whether Government initiatives have been put in place to strengthen conflict prevention frameworks, including the establishment of facilities and the mechanism to support affected communities.

Hon. Senators, I would like to acknowledge the presence of a visiting delegation of two teachers and 50 students from Ontulili Boys Senior School in Buuri West, Meru County, who are seated in the Public Gallery. The delegation is visiting the Senate for an academic exposition. On behalf of the Senate, on my own behalf, I extend a warm welcome to them and wish them a fruitful visit.

ARREST OF MR. JAMES THUKU

1. 2026. Mr. Thuku, a Person with a Disability (PWD), was arrested during the commemoration of the second anniversary of the 25th June, 2024 Anti-Finance Bill protests. This incident raises grave concerns about constitutional compliance, the treatment of PWDs and broader patterns of police brutality in Kenya. In the statement, the committee should address the following-
   1. (1) Compliance with legal and constitutional provisions, including the factual basis for Mr. Thuku's arrest and whether the actions of the officers were consistent with Articles 27, 28, 49, 54 and 244 of the Constitution, the National Police Service Act and the applicable National Police Service Standing Orders.
   2. (2) Assessment of the violation of rights of PWDs, particularly whether the deprivation of the mobility aid on Mr. Thuku and his right to dignity, equality, accessibility and reasonable accommodation was observed, as well as Kenya's obligations under the UN Convention on the Rights of PWDs.
   3. (3) Police brutality against PWDs examining whether this incident reflects a wider pattern of excessive force or discriminatory practices by law enforcement and what safeguards exist to prevent recurrence of the same.
   4. (4) Accountability measures instituted, detailing the identities of officers involved, the status of the disciplinary action and administrative or criminal proceedings and investigations by the Inspector General of the National Police Service (NPS), including whether the NPS will table the final report of the actions taken in front of the Senate.

1. (1) The circumstances surrounding the eviction, including the legal basis for the exercise and the Government agency and or other entity that authorised and conducted it.
2. (2) The due process followed and whether the affected tenants were issued with the requisite notice before the eviction, including copies of the relevant notices, court orders and other authorising documents.
3. (3) The number of households affected, including details of any injuries, arrests, loss or destruction of property reported during the eviction.
4. (4) The measures taken to provide the affected tenants with the emergency shelter, humanitarian assistance, compensation and alternative housing.
5. (5) The action taken against the persons found responsible for their unlawful conduct or the exercise of excessive force during the eviction and measures put in place to prevent similar incidents.

IMPACT OF REMARKS DISCOURAGING TOURISTS FROM VISITING KENYA

The Senate Minority Leader (Sen. Madzayo): I thank you, Mr. Speaker, Sir. I rise pursuant to Standing Order No.53(1) to seek a statement from the Standing Committee on Trade, Industrialisation and Tourism on a matter of national concern regarding the impact of the remarks attributed to the former Deputy President, Hon. Rigathi Gachagua, discouraging tourists from visiting Kenya until after the general election in 2027. The unfortunate utterances negatively portray the nation and have raised widespread public concern over the impact on the country's tourism sector.

This concern is particularly significant because of the sector's contribution to the country's Gross Domestic Product (GDP), foreign exchange earnings and its sustenance of millions of livelihoods. Further, several counties including Kilifi, Mombasa, Kwale, Taita Taveta, Narok, Nakuru, Laikipia, Isiolo, Samburu and Meru derive substantial economic benefits from tourism.

In the statement, the committee should address the following-

1. (1) Whether the Ministry of Tourism and Wildlife has assessed the impact of the remarks attributed to Hon. Gachagua on Kenya’s tourism sector, and if so, obtain findings of such assessment, including details on the ripple effect of any projected decline in tourist arrival on national and county governments’ revenues, employment and business activities particularly in counties whose economies rely heavily on tourism.
2. (2) Mitigation measures being taken by the Ministry of Tourism and Wildlife, the Kenya Tourism Board (KTB) and other relevant Government agencies to reassure international visitors and safeguard Kenya’s reputation as a safe tourist destination.
3. (3) The Government’s broader strategy to safeguard Kenya’s international image and ensure that tourism promotion efforts remain effective during the period heightened by political activities, including details on whether there are plans to engage political leaders and other public figures on the importance of responsible public communication on matters likely to impact Kenya’s international reputation.
4. (4) Policy and legislative actions being considered to strengthen protection of Kenya’s tourism industry against inflammatory statements likely to adversely affect the sector while safeguarding the constitutional right to freedom of expression.

THE KENYA ROADS (AMENDMENT)(NO.3) BILL (NATIONAL ASSEMBLY BILLS NO.34 OF 2025)

Sen. Madzayo. I thank him and other leaders from the Coast. Yesterday, I saw our Speaker, CS Joho and our Senate Minority Leader.

Every day, Kenyans continue to appreciate why we impeached Rigathi Gachagua. This is because the statement he made is equal to economic sabotage, which is treasonous. Saying that tourists should not visit Kenya or people should not invest in Kenya is killing a region. We cannot allow such a leader to lead this nation - God forbid. His mindset is that of a sadist who is power-hungry. He is being selfish and wants to kill the businesses of other Kenyans. I want to thank the Senate Minority Leader for taking this bold step. He must be called out. I also thank the new Senate Deputy Minority Whip.

I want us to look at the numbers. Last year, this country generated Kshs500 billion through tourism. A running tourism industry means somebody working in a hotel in Kilifi or Diani will have a job. More than 7.9 million tourists visited Kenya. They visited several counties such as Nakuru, Narok, Kajiado and others across the country. Out of that number, 2.7 million of them were foreign visitors and we are now targeting more than three million foreign visitors.

That projection will create 10 per cent Gross Domestic Product (GDP) in 2026 which will be US$12.7 billion. We cannot allow Mr. Rigathi Gachagua to incite people. I want to call on the National Cohesion and Integration Commission (NCIC) to look into these matters. The NCIC must ensure that Mr. Rigathi Gachagua records a statement for economic saboteurs. What he has done is treasonable.

I call upon the leaders of the coastal region and those from the Rift Valley, Migori, Nandi, Nakuru and even Nanyuki to speak out because this is not just a coastal affair. It is a national affair and must be treated with the considerations it deserves. According to Infotrak Research and Consulting, he only has four per cent support of Kenyans. That shows that the person pushing a tribal agenda will never see the leadership of this country. God forbid if he ever runs for a national office.

It was even a grievous mistake to make him the Deputy President. The Azimio team complained then, but we did not appreciate it, but we now appreciate removing him. Having him as a Deputy President of this Republic was a grievous mistake. We continue to prove ourselves right for impeaching him each every year. He has been impeached. If he runs for any seat in this country, we will continue to impeach him because he has failed. That is why he has retreated to a small village called Wamunyoro, because his thinking is village thinking. He cannot think as a national leader. He cannot think as an international---

With those many remarks, I beg to support.

The truck was burnt in the middle of the road hence Kenyans and tourists could not travel on that particular day.
