MEMORANDUM OFOBJECT AND REASONS

Theprincipal object of theBill is toamend the CropsAct Cap.318 to differentiate muguka, from Miraa and therefore expressly exclude muguka from being a scheduled crop.

Clause 1 is the short title.

Clause 2 provides for the exclusion of muguka as a scheduled crop.

Statement on the delegation of legislative powers and limitation of

fundamental rights and freedoms.

The Bill does not delegate legislative power and does not limit fundamental rights and freedoms.

Statement on whether the Bill concerns county governments

The Bill is a Bill concerning county governments under Article 110(1)(a) of the Constitution. Agriculture including crop and animal husbandry is a function of the county governments under section l(a) of Part 2of theFourth Schedule to the Constitution.

Statement that the Bill is not money Bill within the meaning of

Article 114of the Constitution

The enactment of this Bill shall not occasion additional expenditure of public funds.
