I. THE KENYA NATIONAL LIBRARY SERVICE BILL

(NATIONAL ASSEMBLY BILL NO. 20 OF 2023)

Notice is given that the Chairperson of the Departmental Committee on Sports and Culture intends to move the following amendments to the Kenya National Library Service Bill, 2023 at the Committee Stage—

LONG TITLE

THAT, the Long Title to the Bill be amended by inserting the words “to give effect to Article 11(2)(a) of the Constitution;” immediately after the words “An Act of Parliament”

CLAUSE 5

THAT, the Bill be amended by deleting clause 5 and substituting therefor the following new clauses⎯

Role of the National Government.

1. 5. The National Government shall be responsible for⎯

(a) development of a national policy, legislation and the setting of standards for the library sector; (b) capacity building and technical assistance to the county governments; (c) carrying out and promoting research in the development of libraries and related services; (d) promotion of literacy in the country; (e) domestication of international standards relating to library services; (f) publishing the Kenya National Bibliography and the Kenya Periodicals Directory; (g) establishment of the national webcat to publish catalogues for all libraries in the country; and (h) establishment and maintenance of a national virtual library service.

Role of county governments. 5A. The county governments shall be responsible for⎯ (a) implementation of the national policy, legislation and standards for the library sector; (b) equipping, developing, managing and maintaining county libraries; (c) acquiring and maintaining comprehensive periodic bibliographies for county libraries;

(d) establishing and managing county centres for books to promote reading, writing and publishing culture; (e) promotion of reading for knowledge, information and enjoyment through the stimulation of public interest in books and participation in campaigns for the eradication of illiteracy; (f) providing communities with information materials, programs and services through stocking relevant learning resources for formal and informal education; (g) carrying out sensitization in counties to promote learning; (h) providing a conducive learning environment and stimulating and promoting public interest in reading books for information, knowledge and enjoyment; (i) promoting information and communication technology in accessing and disseminating information; (j) providing lending, outreach and specialized services in relation to county libraries; (k) providing advisory, library reference and county library referral services; and (l) liaising with relevant institutions to enhance information sharing.

CLAUSE 6

THAT, clause 6 of the Bill be amended in sub-clause (1)(i) by inserting the words “and an ex officio member” immediately after the words “Chief Executive Officer”

CLAUSE 7

THAT, clause 7 of the Bill be amended⎯ (a) in sub-clause (1)- (i) by deleting the word “degree” appearing in paragraph (b) and substituting therefor the words “minimum of a bachelor’s degree” (ii) by deleting the word “seven” appearing in paragraph (c) and substituting therefor the word “five”; (b) in sub-clause (2)⎯ (i) by deleting the word “degree” appearing in paragraph (b) and substituting therefor the words “minimum of a bachelors’ degree”; (ii) by deleting the word “five” appearing in paragraph (c) and substituting therefor the word “three”

CLAUSE 8

THAT, Clause 8 of the Bill be amended by deleting paragraph (f).

CLAUSE 10

THAT, Clause 10 of the Bill be amended in paragraph (c) by inserting the words “without the option of a fine” immediately after the words “imprisonment exceeding six months”

CLAUSE 14

THAT, Clause 14 of the Bill be amended by inserting the words “Salaries and Remuneration” immediately after the words “in consultation with the”.

CLAUSE 15

THAT, Clause 15 of the Bill be amended⎯ (a) in sub-clause (1) by deleting the word “once” and substituting therefor the words “for one further term of three years”; (b) in sub-clause (2)⎯ (i) by deleting the words “masters degree” appearing in paragraph (b) and substituting therefor the words “minimum of a masters’ degree”; (ii) by deleting paragraph (c) and substituting therefor the following new paragraph- “(c) has at least ten years professional experience of which at least five years are at senior management level; and”

CLAUSE 29

THAT, Clause 29 of the Bill be amended by deleting the words “Director-General” and substituting therefor the words “Corporation Secretary”.

FIRST SCHEDULE

THAT, the First Schedule to the Bill be amended by deleting paragraph (5) and substituting therefor the following new paragraph⎯ “(5) The minutes of each meeting of the Board or of a committee of the Board shall be kept by the Corporation Secretary and shall be confirmed by the Board or the committee at the succeeding meeting and be duly signed

LIMITATION OF DEBATE

The House resolved on Thursday, February 13, 2025 as follows—

Limitation of Debate on Motions

II.

THAT, each speech in a debate on any Motion, including a Special motion be limited in the following manner: A maximum of three hours with not more than twenty (20) minutes for the Mover and ten (10) minutes for each other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each, and that ten (10) minutes before the expiry of the time, the Mover be called upon to reply; and that priority in speaking shall be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

Limitation of Debate on Reports of Audit Committees III. THAT, each speech in debate on Reports of Audit Committees be limited as follows: A maximum of sixty (60) minutes for the Mover in moving and thirty (30) minutes in replying, and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each; and that priority be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.

Limitation of Debate on Bills sponsored by Parties or Committees IV. THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen minutes (15) each (if the Bill is not sponsored by either of them); and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

THAT, each speech in a debate on any Sessional Paper be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party and the Chairperson of the relevant Committee (if the Sessional Paper is not moved by the Chairperson of the relevant Committee), and that ten (10) minutes before the expiry of the time, the Mover be called upon to reply; and further that priority in speaking be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.
