I. THE KENYA NATIONAL LIBRARY SERVICE BILL

(NATIONAL ASSEMBLY BILL NO. 20 OF 2023)

Notice is given that the Chairperson of the Departmental Committee on Sports and Culture intends to move the following amendments to the Kenya National Library Service Bill, 2023 at the Committee Stage—

LONG TITLE

THAT, the Long Title to the Bill be amended by inserting the words “to give effect to Article 11(2)(a) of the Constitution;” immediately after the words “An Act of Parliament”

CLAUSE 5

THAT, the Bill be amended by deleting clause 5 and substituting therefor the following new clauses⎯

Role of the National Government.

1. 5. The National Government shall be responsible for⎯

(a) development of a national policy, legislation and the setting of standards for the library sector; (b) capacity building and technical assistance to the county governments; (c) carrying out and promoting research in the development of libraries and related services; (d) promotion of literacy in the country; (e) domestication of international standards relating to library services; (f) publishing the Kenya National Bibliography and the Kenya Periodicals Directory; (g) establishment of the national webcat to publish catalogues for all libraries in the country; and (h) establishment and maintenance of a national virtual library service.

Role of county governments. 5A. The county governments shall be responsible for⎯ (a) implementation of the national policy, legislation and standards for the library sector; (b) equipping, developing, managing and maintaining county libraries; (c) acquiring and maintaining comprehensive periodic bibliographies for county libraries;

(d) establishing and managing county centres for books to promote reading, writing and publishing culture; (e) promotion of reading for knowledge, information and enjoyment through the stimulation of public interest in books and participation in campaigns for the eradication of illiteracy; (f) providing communities with information materials, programs and services through stocking relevant learning resources for formal and informal education; (g) carrying out sensitization in counties to promote learning; (h) providing a conducive learning environment and stimulating and promoting public interest in reading books for information, knowledge and enjoyment; (i) promoting information and communication technology in accessing and disseminating information; (j) providing lending, outreach and specialized services in relation to county libraries; (k) providing advisory, library reference and county library referral services; and (l) liaising with relevant institutions to enhance information sharing.

CLAUSE 6

THAT, clause 6 of the Bill be amended in sub-clause (1)(i) by inserting the words “and an ex officio member” immediately after the words “Chief Executive Officer”

CLAUSE 7

THAT, clause 7 of the Bill be amended⎯ (a) in sub-clause (1)- (i) by deleting the word “degree” appearing in paragraph (b) and substituting therefor the words “minimum of a bachelor’s degree” (ii) by deleting the word “seven” appearing in paragraph (c) and substituting therefor the word “five”; (b) in sub-clause (2)⎯ (i) by deleting the word “degree” appearing in paragraph (b) and substituting therefor the words “minimum of a bachelors’ degree”; (ii) by deleting the word “five” appearing in paragraph (c) and substituting therefor the word “three”

CLAUSE 8

THAT, Clause 8 of the Bill be amended by deleting paragraph (f).

CLAUSE 10

THAT, Clause 10 of the Bill be amended in paragraph (c) by inserting the words “without the option of a fine” immediately after the words “imprisonment exceeding six months”

CLAUSE 14

THAT, Clause 14 of the Bill be amended by inserting the words “Salaries and Remuneration” immediately after the words “in consultation with the”.

CLAUSE 15

THAT, Clause 15 of the Bill be amended⎯ (a) in sub-clause (1) by deleting the word “once” and substituting therefor the words “for one further term of three years”; (b) in sub-clause (2)⎯ (i) by deleting the words “masters degree” appearing in paragraph (b) and substituting therefor the words “minimum of a masters’ degree”; (ii) by deleting paragraph (c) and substituting therefor the following new paragraph- “(c) has at least ten years professional experience of which at least five years are at senior management level; and”

CLAUSE 29

THAT, Clause 29 of the Bill be amended by deleting the words “Director-General” and substituting therefor the words “Corporation Secretary”.

FIRST SCHEDULE

THAT, the First Schedule to the Bill be amended by deleting paragraph (5) and substituting therefor the following new paragraph⎯ “(5) The minutes of each meeting of the Board or of a committee of the Board shall be kept by the Corporation Secretary and shall be confirmed by the Board or the committee at the succeeding meeting and be duly signed

LIMITATION OF DEBATE

The House resolved on Thursday, February 13, 2025 as follows—

Limitation of Debate on Reports of Audit Committees II. THAT, each speech in debate on Reports of Audit Committees be limited as follows: A maximum of sixty (60) minutes for the Mover in moving and thirty (30) minutes in replying, and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each; and that priority be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.

Limitation of Debate on Bills sponsored by Parties or Committees III. (ii) outline the steps taken by the Ministry, in collaboration with the County Government of Kiambu to resolve the ongoing Doctors’ strike which has resulted in a strain on Kenyatta National Hospital as it is handling more than twice its normal capacity?

(iii) provide statistical data on the number of maternal and new- born deaths recorded in Hospitals within Kiambu County, particularly between June and September 2025?

(iv) explain the reasons for the withdrawal and redeployment of medical interns who had been posted to various hospitals within Kiambu County?

Faith Gitau, MP) to ask the Cabinet Secretary for Health: - Could the Cabinet Secretary— (i) provide a report on the measures the Ministry has put in place to avert a potential tuberculosis crisis as many patients are resistant to its drugs for treatment, including ensuring timely access to prevention, testing, and treatment services?

(ii) outline the actions being undertaken by the Ministry to secure affordable treatment for multi-drug-resistant tuberculosis, considering its’ more challenging and prolonged treatment regimen?

(iii) state the efforts in place to preserve and build upon the progress previously achieved in the fight against tuberculosis through USAID funding?

(ii) state the factors contributing to the prolonged delay in remitting payments to Consolata Hospital Mathari, despite the provision of healthcare services to patients?

(iii) outline the measures put in place to ensure the debt owed to the hospital is promptly settled and its operations fully restored?

(iv) provide a timeline for the payment of the arrears and dues accumulated from October 2024 to April 2025 to Consolata Hospital Mathari by SHA?

074/2025 The Member for Matuga (Hon. Kassim Tandaza, MP) to ask the Cabinet Secretary for Health: - Could the Cabinet Secretary— (i) provide a report of payments made by the Social Health Insurance Fund (SHIF) including the number of Vulnerable people catered for by SHIF in Matuga Constituency and nationally?

(ii) state the timelines within which the Social Health Authority (SHA) will reconcile payments made under NHIF through NG-CDF that were not transferred to SHIF and indicate the fate of these payments?

(iii) outline measures implemented to cover the patients who are unable to pay their balances after exhausting their SHIF Cover?

(iv) state the plans put in place to clear balances of patients detained in public hospitals due to their pending hospital bill balances after exhaustion of their SHIF Cover?

075/2025 The Member for Member for Laikipia West (Hon. Stephen Karani, MP) to ask the Cabinet Secretary for Health:- Could the Cabinet Secretary— (i) explain why informal sector workers are no longer able to remit monthly contributions to the Social Health Insurance Fund (SHIF) under the Social Health Authority (SHA), including being required to make top-up contributions when receiving medical services from hospital creating discrimination as this requirement is not imposed on salaried individuals?

(ii) clarify whether any assessment has been undertaken on the impact of requiring annual contributions from informal sector workers on their right to access affordable healthcare?

(iii) outline the alternative payment models accessible to informal sector workers and measures put in place to ensure inclusivity and flexibility in the remittance of SHIF contributions, particularly for low-income earners in the informal sector?

077/2025 The Member for Kiambaa (Hon. John Wanjiku, MP) to ask the Cabinet Secretary for Health: - Could the Cabinet Secretary— (i) provide a report on the number of Kenyans that have registered with the Social Health Authority (SHA) including measures taken by the Ministry to sensitise the public on payment of premiums and the benefits available under the packages offered by the Authority?

(ii) clarify on whether indigents are subjected to a means testing process and if so, provide a report on whether claims by indigents have been fully paid for and the number of indigent households that have benefited under SHA?

(iii) outline the current uptake of premium financing and the utilization of the Lipa Pole Pole Scheme under SHA for Kenyans in the informal sector?

(iv) provide the status of recruitment by the SHA and whether staff of the defunct National Health Insurance Fund (NHIF) have been transitioned to the Authority?

(v) indicate the status of the suspension and investigation of health facilities that had integrity issues including actions taken by the Ministry to resolve the matter and ensure accountability by health facilities?

(vi) clarify whether the Rural and Urban Private Hospitals Association (RUPHA) allied facilities are accepting and treating SHA members in their facilities?

078/2025 The Member for Samburu West (Hon. Naisula Lesuuda, MP) to ask the Cabinet Secretary for Health: - Could the Cabinet Secretary— (i) outline measures put in place to ensure the provision of quality healthcare services and patient safety in health facilities including the manner in which pre-authorization for admission and procedures is done by the Social Health Authority (SHA)?

(ii) clarify whether the Ministry of Health, the Social Health Authority and Kenya Medical Practitioners and Dentists Council (KMDPC) conduct inspections of the contracted health facilities to ensure strategic purchasing of services and that SHA members receive quality healthcare services?

(iii) state measures put in place to ensure availability of drugs in Health Care Facilities by Kenya Medical Supplies Authority (KEMSA) including improving the institution’s order-fill-rate and ensuring uninterrupted supply of drugs?

(iv) explain the relationship between the Social Health Authority, the Digital Health Agency and the Kenya Medical Practitioners and Dentists Council (KMDPC) with regard to updating of bed capacity, empanelment, pre-authorization, claim settlements, system downtime and surgical reviews?

(v) explain why the Social Health Authority Tribunal has not been operationalized and explain how disputes in relation to billing disputes, claim rejections and closure of facilities are being handled by SHA, KMDPC and the Ministry?

(vi) clarify whether Kenyans may seek medical services outside Kenya under the Social Health Insurance Fund (SHIF), and if so, provide the procedures that are to be followed for getting approvals to be treated outside of the country by the Social Health Authority?

(vii) Provide a report on the manner which the Social Health Authority empanels and pays health facilities outside of Kenya?

079/2025 The Member for Kinangop (Hon. Kwenya Thuku, MP) to ask the Cabinet Secretary for Health: - Could the Cabinet Secretary— (i) explain what entails the Linda Jamii programme including whether there are any benefits categorized for maternal, newborn and child health?

(ii) provide a report on the statistics of teenage mothers and their children being treated under the Social Health Authority?

(iii) state how much has been paid to facilities by the Social Health Authority under the Public Officers Medical Scheme Fund including how much has been paid to the Fund by the Ministry of Public Service?

(iv) outline the current status of NHIF outstanding debts and the verification of the outstanding claims?

(v) provide the reasons or grounds upon which SHA rejects claims including whether such reasons are provided to health facilities and the measures put in place to ensure that the 9,000 contracted health facilities are trained on claims processing, SHA digital systems and financial accountability?

(vi) state whether SHA is paying for emergency services provided to Kenyans and if so, explain how are ambulances contracted by SHA, including procedures for referrals where ambulances are involved?

(vii) indicate the level of ambulance coverage in rural and far-flung areas of the country?

(viii) explain how the Ministry is engaging and supporting County Governments in the Implementation of the Facility Improvement Financing Act, Cap. 277?

(ix) state the measures put in place to ensure that county laws are aligned to the national legal framework on Facility Improvement Financing?

(x) outline the steps taken by the Ministry to regulate organ and tissue donation and transplants in the country?
