I. MEDIATED VERSION OF THE DIVISION OF REVENUE

BILL (NATIONAL ASSEMBLY BILL NO. 2 OF 2026)

THE DIVISION OF REVENUE, BILL 2026

A Bill for AN ACT of Parliament to provide for the equitable Division of Revenue raised nationally between the National and County governments in the 2026/27 financial year, and for connected purposes ENACTED by the Parliament of Kenya, as follows—

1. 1. This Act may be cited as the Division of Revenue Act, 2026.

Short title.

1. 2. In this Act, unless the context otherwise requires—

Interpretation. “Cabinet Secretary” means the Cabinet Secretary for the time being responsible for matters relating to finance; and

“revenue” has the meaning assigned to it under section 2 of the Commission on Revenue Allocation Act. Cap.428.

1. 3. The object and purpose of this Act is to provide for the equitable

sharing of revenue raised by the national government among the national and county levels of government in the 2026/27 financial year in accordance with Article 202(1) and 203(2) of the Constitution.

Object and purpose of the Act.

1. 4. Revenue raised nationally in respect of the 2026/27 financial year

shall be shared equitably among the national and county governments as set out in the Schedule to this Act. Allocations to national government and county governments.

1. 5. (1) If the actual revenue raised nationally in the financial year falls

short of the expected revenue set out in the Schedule, the short fall shall be borne by the national government.

Variation in revenue. (2) If the actual revenue raised nationally in the financial year exceeds the projected revenues set out in the Schedule, the excess revenue shall accrue to the national government, and may be used to reduce borrowing or offset debts.

LIMITATION OF DEBATE

The House resolved on Wednesday, February 11, 2026 as follows—

Limitation of Debate on Other Committee Reports II. THAT, each speech in a debate on Other Committee Reports, including a Report of a Joint Committee of the Houses of Parliament or any other Report submitted to the House for which limitation of time has not been specified, be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party and the Chairperson of the relevant Committee (if the Committee Report is not moved by the Chairperson of the relevant Committee), and that ten (10) minutes before the expiry of the time, the Mover shall be called upon to reply; and further that priority in speaking shall be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.

Limitation of Debate on Bills sponsored by Parties or Committees III. THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen minutes (15) each (if the Bill is not sponsored by either of them); and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

THAT, each speech in debate on Reports of Audit Committees be limited as follows:- A maximum of sixty (60) minutes for the Mover in moving and thirty (30) minutes in replying, and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each; and that priority be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.
