DISASTER RISK MANAGEMENT BILL (NATIONAL

ASSEMBLY BILL NO. 24 OF 2023)

It is notified that the Senate made the following amendment to the National Disaster Risk Management Bill, 2023 ―

CLAUSE 3

Senate Amendment THAT, the Bill be amended in Clause 3 by inserting the following new paragraphs immediately after paragraph (b) –

(ba) provide for appropriate and dignified assistance and relief to victims and casualties of disasters;

(bb) promote inclusiveness and a multidisciplinary and multisectoral approach to disaster management.

CLAUSE 4

Senate Amendment THAT, the Bill be amended in Clause 4 by deleting paragraph (e) and substituting therefor the following new paragraph — (a) the national values and principles of governance under Article 10 of the Constitution.

CLAUSE 6

Senate Amendment THAT, the Bill be amended in Clause 6 by deleting subclause (2) and substituting therefor, the following new subclause – (2) The Authority shall collaborate with the County Disaster Risk Management Committees in all counties in the discharge of its functions. CLAUSE 7

Senate Amendment THAT, the Bill be amended in Clause 7 by inserting the following new paragraphs immediately after paragraph (m) —

(ma) develop climate change adaptation strategies to prevent, respond and mitigate the effects of disasters arising as a result of climate change; (mb) carry out and coordinate national damage and loss assessment in respect to disasters; (The Committee recommends approval of the Senate Amendment)

CLAUSE 9

Senate Amendment THAT, the Bill be amended in Clause 9 subclause (1)(f) by deleting the word “Governors” appearing immediately after the words “Council of” and substituting therefor the words “County Governors or a representative designated in writing”.

CLAUSE 10

Senate Amendment THAT, the Bill be amended in Clause 10 subclause (2) by deleting paragraph (g).

Senate Amendment THAT, the Bill be amended in Clause 27 subclause (1) by inserting the words “in consultation with County Governments” immediately after the words “The Authority shall”.

CLAUSE 29

Senate Amendment THAT, the Bill be amended in Clause 29 subclause (8) by inserting the words “in consultation with the Council of County Governors” immediately after the words “Cabinet Secretary shall”.

CLAUSE 32

Senate Amendment THAT, the Bill be amended in Clause 32 subclause (1)– (a) by deleting paragraph (b); (b) in paragraph (c) by inserting the words “in collaboration with the County Disaster Risk Management Centers,” immediately before the word “formulate”; (c) in paragraph (h) by inserting the words “in collaboration with the County Disaster Risk Management Centre and the Authority,” immediately after the word “oversee”; and (d) in paragraph (m) by inserting the words “and the respective county assembly” immediately after the words “to the Authority”.

CLAUSE 52

Senate Amendment THAT, the Bill be amended in Clause 52– (a) by deleting the heading to Part VII and substituting therefor the following new heading –

PART VII – MISCELLANEOUS PROVISIONS

(b) in subclause (2) by inserting the following new paragraph immediately after paragraph (h) — (ha) protection of emergency responders during emergency and disaster response.

NEW CLAUSES 41A, 41B, 41C, 41D AND 41E

Senate Amendment THAT, the Bill be amended by inserting the following new clauses immediately after Clause 41— Establishment of the Disaster Management Fund. Cap 412A. 41A. (1) There is established the Disaster Risk Management Fund which shall be administered in accordance with section 24 of the Public Finance Management Act. (2) The Director-General of the Authority shall be the administrator of the Fund.

Sources of the Fund 41B. The Fund shall consist of — (a) such moneys as may be appropriated by the National Assembly; (b) grants or donations for the purposes of the Fund; (c) income generated from the proceeds of the Fund; and (d) any moneys accruing to or received by the Fund from any other lawful source, as may be approved by the Cabinet Secretary for the time being responsible for finance.

Objects of the Fund 41C. The Fund shall — (a) be utilized towards the provision of funds for disaster prevention, preparedness, mitigation, response and recovery measures; (b) provide a common basket for receipt and disbursement of funds for disaster management; (c) support capacity development of county governments and other institutions mandated with disaster management; (d) support agencies dealing with early warning systems for disaster management; (e) support the implementation of programmes, projects or activities to further the objectives of this Act; and (f) support any other purpose approved by the Board that would enhance the development and promotion of prudent disaster management in the country.

Consolidation of Public funds related to disaster management 41D. All public funds established for the purpose of disaster management prior to the commencement of this Act shall be consolidated into the Fund, except funds —

(a) established to support institutions created under an Act of Parliament; or (b) established by county governments.

Tax Exemptions on Disaster Management Assistance. 41E. The Cabinet Secretary responsible for finance may, by regulation, exempt all materials, articles, goods or equipment intended for the use of disaster management activities from import duty, value added tax, demurrage charges, port charges and any other tax as may be determined.

CLAUSE 2

Senate Amendment THAT, the Bill be amended in Clause 2 by inserting the following definitions in their proper alphabetical order – “emergency” means an actual or imminent situation that arises suddenly, poses immediate threat to life, health, property, environment, infrastructure, economic stability or public order and that – (a) requires prompt coordinated action to protect life and property and restore essential services; (b) may be caused by natural, technological, human-induced, health or industrial incidents; and (c) exceeds normal response capabilities requiring multi-agency intervention;

“emergency responder” refers to a person involved in an organized response to a potential, actual or impending emergency, including but not limited to firefighters, police officers, emergency medical personnel, county government emergency management personnel, national government emergency management personnel, military personnel or an officer of a recognized humanitarian organization dealing with disaster response.

LIMITATION OF DEBATE

The House resolved on Thursday, February 13, 2025 as follows— Limitation of Debate on Bills sponsored by Parties or Committees II. THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen minutes (15) each (if the Bill is not sponsored by either of them); and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

Limitation of Debate on Consideration of Senate Amendments to Bills originating in the National Assembly

III.

THAT, each speech in the general debate contemplated under Standing Order 146 (Consideration of Senate amendments to Bills originating in the National Assembly) be limited as follows:- A maximum of one hour and thirty minutes, with not more than fifteen minutes (15) for the Mover in moving, fifteen minutes (15) for the Chairperson of the relevant Departmental Committee, and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party (if the Bill is not party-sponsored), and that five (5) minutes before the expiry of the time, the Mover shall be called upon to reply; and further that priority in speaking shall be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

Limitation of Debate on Reports of Audit Committees IV. THAT, each speech in debate on Reports of Audit Committees be limited as follows: A maximum of sixty (60) minutes for the Mover in moving and thirty (30) minutes in replying, and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each; and that priority be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.

THAT, each speech in a debate on Other Committee Reports, including a Report of a Joint Committee of the Houses of Parliament or any other Report submitted to the House for which limitation of time has not been specified, be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party and the Chairperson

(ii) clarify whether the contractor responsible for the road project received full payment, and whether due process was followed in the payment process?

(iii) outline the measures taken by the Ministry to address structural defects such as cracks and sliding grounds along the road, particularly around Kisigiwa?

(iv) provide the timelines for the construction of the said road?

014/2025 The Member for Ruiru (Hon. Simon King’ara, MP) to ask the Cabinet Secretary for Roads and Transport: - Could the Cabinet Secretary-

(i) explain why the new generation smart driving license does not indicate the date when the holder first obtained it?

(ii) consider integrating the or iginal date of license issuance into the smart driving license, particularly for individuals upgrading from older versions, to support Kenyan drivers abroad who rely on this information to verify their driving experience?

015/2025 The Member for Teso South (Hon. Mary Emaase, MP) to ask the Cabinet Secretary for Roads and Transport: - Could the Cabinet Secretary- (i) indicate when the Busia-Malaba road which is in a dilapidated state will be maintained and upgraded to bitumen standards?

(ii) outline measures put in place by the Ministry to ensure that major highways such as the Busia-Malaba road is continuously maintained? 053/2025 The Member for Moiben (Hon. (Prof.) Phylis Bartoo, MP) to ask the Cabinet Secretary for Roads and Transport: - Could the Cabinet Secretary-

(i) explain why, despite the completion of their designs, construction on the Tachasis-Chebiemit, Ainet-Chebarus, and Riadha roads has not yet commenced?

(ii) outline the main causes of these delays and provide the current plans, milestones and timelines for initiating and completing these critical road projects?

(iii) indicate what measures will be put in place to address the concerns of Moiben Constituency residents, for whom these roads are vital to connectivity, economic growth and overall regional development?

054/2025 The Member for Kinango (Hon. Gonzi Rai, MP) to ask the Cabinet Secretary for Roads and Transport:- Could the Cabinet Secretary- (i) state the current condition of Kinango/Mariakani road (C107) and the impact of the recent rains on its deterioration, particularly the drift connecting the road?

(ii) explain the immediate measures the government is taking to prevent further deterioration of the road and restore its usability for motorists?

(iii) outline both short-term and long-term interventions, including any placed collaborations with other agencies, to provide a lasting solution for repair and maintenance of the road?

(iv) clarify whether there is a budgetary allocation for upgrading the road to bitumen standards in the 2024/2025 financial year, and if so, what steps have been taken to upgrade the road and details of the costs allocated?

057/2025 The Member for Naivasha (Hon. Jayne Kihara, MP) to ask the Cabinet Secretary for Roads and Transport: - Could the Cabinet Secretary- (i) clarify whether compensation for land acquired by the Kenya Railways Corporation for the construction of the Standard Gauge Railway (SGR) and Meter Gauge Railway (MGR) by has been fully settled?

(ii) provide details on the criteria used to identify legitimate landowners, and clarify whether compensation was determined based on prevailing market rates?

(iii) explain why some legitimate landowners were not compensated for their land acquired for the construction of the railway line and outline measures the Ministry has put in place to ensure that all genuinely affected landowners are duly compensated?
