THAT, this House adopts the Report of the Budget and Appropriations Committee on the Supplementary Estimates II for the Financial Year 2021/2022, laid on the Table of the House on Tuesday, June 7, 2022 and pursuant to the provisions of Article 223 of the Constitution and Standing Order 243-

(i) approves an increment of the total expenditure for Financial Year 2021/2022 by Kshs70,847,524,597 being Current Estimates of Ksh. 65,012,661,186 and Capital Estimates of Ksh.5,861,863,411 in respect of the Votes as contained in the attached Schedule I; (ii) approves Kshs.27,257,307,265 for Financial Year 2021/2022 spent under Article 223 of the Constitution and as contained in the attached Schedule II; and, (iii) resolves that the attached Schedules form the basis for the introduction of the Second Supplementary Appropriation Bill, 2022.

II. THE PUBLIC SERVICE COMMISSION (AMENDMENT) BILL

CLAUSE 2
THAT, the Bill be amended by deleting clause 2 and substituting therefor the following new clause ―
Amendment of section 34 of No. 10 of 2017.
- 2. Section 34 of the “principal Act” is amended by inserting the following
new subsection immediately after subsection (3)―

“(3A) An appointing authority who fails to fill a vacant position under subsection (3) within six months, commits an offence, and shall, on conviction, be liable to a fine of not exceeding five hundred thousand shillings or imprisonment for a term of not exceeding six months, or to both.”

THAT, the Bill be amended by deleting clause 3 and substituting therefor the following new clause ―
Amendment of section 80 of No. 10 of 2017.
- 3. Section 80 of the “principal Act” is amended―
(a) in subsection (1)― (i) by deleting the words “as may be prescribed in the regulations” and substituting therefor the words “of fifty five years and for persons with disabilities the mandatory age of sixty years”; (ii) by inserting the following new subsections immediately after subsection (1)― “(1A) A person who appoints a retired public officer in a State office or Public office commits an offence, and shall, on conviction, be liable to a fine of not exceeding five hundred thousand shillings or imprisonment for a term of not exceeding six months, or to both.” (1B) The Cabinet Secretary may prescribe a period not exceeding three years— (a) exempting any person or class of persons from compliance with this section; or (b) extending the time for compliance by any person or class of persons with this section. (b) by deleting subsection (2).
NEW CLAUSE
THAT, the Bill be amended by inserting a new clause immediately after clause 1―
Amendm ent of section 2 of No.10 of 2017. 1A. Section 2 of the Public Service Commission Act, 2017(in this Act referred to as the “principal Act”) is amended by deleting the definition of “public officer” and substituting therefor the following new definition― “public officer” means any person other than a state officer who holds a public office or a state officer who holds a public office or state office but not a state officer who holds an elective position.

CLAUSE 39
THAT, the Bill be amended in clause 39 –
(a) in subsection (1) by deleting the expression “section 39” and substituting therefor the expression “section 38”; (b) by deleting subsection (2).
CLAUSE 40
THAT, the Bill be amended by deleting clause 40 and substituting therefor the following new section-
Funds of the Institute.
- 40. The funds of the Institute shall consist of –
(a) monies payable to the Institute under this Act; (b) subscription fees; (c) donations, gifts and endowments from lawful sources; (d) grants.

THAT, the Bill be amended in clause 44 by deleting the words “or Examinations Board”.

THAT, the Bill be amended in clause 45 (1) by deleting the word “Council” and substituting therefor the word “Cabinet Secretary”.
NEW CLAUSE
THAT, the Bill be amended by inserting the following new clause immediately after clause 44-
Transitional provision 44A. (1) After the expiration of twelve months or such longer period as the Cabinet Secretary may declare, by notice in the Gazette after the commencement of this Act, that no person shall practise as an Insurance Professional unless he or she is a holder of a practising certificate that is in force.
(2) Any person who contravenes subsection (1) shall be guilty of an offence and liable to a fine not exceeding fifty thousand or imprisonment for a period not exceeding six months.
FIRST SCHEDULE
THAT, the Bill be amended in the First Schedule in Item 2 by deleting-
(a) subparagraph (3); (b) subparagraph (4).
THIRD SCHEDULE.
THAT, the Bill be amended by deleting the Third Schedule.

THAT, the heading of the long title of the Bill be amended by deleting the word “REGISTRATION”.

CLAUSE 1
THAT, clause 1 of the Bill be amended by deleting the word “Registration”.
CLAUSE 2
THAT, clause 2 of the Bill be amended by inserting the following new definition in the proper alphabetical sequence— “professional prequalification” means a certificate in insurance studies that is issued by an institution approved or recognized by the Commission for University Education established under the Universities Act, 2012 or the Technical and Vocational Education and Training Authority established under the Technical and Vocational Education and Training Act, 2013 which certificate shall be required by the Examinations Board as a requirement for candidates who apply to sit the insurance professional examinations;”
CLAUSE 4
THAT, clause 4 of the Bill be amended in sub-clause (2) by— (a) deleting paragraph (c); (b) deleting paragraph (d); and (c) deleting paragraph (e).
CLAUSE 5
THAT, clause 5 of the Bill be amended in sub-clause (1) —
(a) by deleting paragraph (f) and substituting therefor the following new paragraph— “(f) co-ordinate and oversee continuous professional development of insurance professionals;” (b) in paragraph (g) by deleting the words “Technical and Vocational Education and Training Authority” and substituting therefor the words “Examinations Board”; and (c) by inserting the following new paragraph immediately after paragraph (j); “(ja)advise the Registration Committee on matters relating to grant of practicing certificates;”
CLAUSE 6
THAT, clause 6 of the Bill be amended— (a)in the opening statement by inserting the word “comprise” immediately after the word “shall”; and (b) in paragraph (f) by inserting the words “who shall be an ex officio member of the Council” immediately after the word “Institute”.
CLAUSE 17
THAT, clause 17 of the Bill be amended in sub-clause (1)— (a)by deleting paragraph (f); and (b) in paragraph (g) by deleting the word “two” and substituting therefor the word “three”.

THAT, clause 18 of the Bill be amended— (a) in sub-clause (1) by deleting the word “to” and substituting therefor the word “of”; (b) in sub-clause (2) by deleting the word “to” and substituting therefor the word “of”; and (c) in sub-clause (4) by deleting the words “Registrar to” and substituting therefor the word “Registrar of”.
CLAUSE 19
THAT, clause 19(1) of the Bill be amended — (a) in paragraph (b) by inserting the words “insurance professionals” immediately after the word “to”; (b) in paragraph (c) by inserting the words “for insurance professionals” immediately after the word “requirements”; and (c) in paragraph (d) by inserting the words “for insurance professionals” immediately after the word “examinations”.
CLAUSE 20
THAT, clause 20 of the Bill be amended by deleting sub-clause (1) and substituting therefor the following new sub-clause — (1) After the expiration of twelve months or such longer period as the Cabinet Secretary may declare by notice in the Gazette, after the commencement of this Act, a person shall subject to section 21(2), practice as an insurance professional if he or she is the holder of a practicing certificate that is in force.
CLAUSE 21
THAT, clause 21 of the Bill be amended by inserting the following new sub-clause immediately after sub-clause(2) — (2) Despite subsection (1) and subsection (2) a person who is duly registered as an agent under the Insurance Act, shall be deemed not to be in breach of section 20 where they sell or market insurance products or services either on their own account, or on behalf of an insurer, a re-insurer, an insurance broker or in association with others.
CLAUSE 23
THAT, clause 23 (2) of the Bill be amended by deleting the words “Registration Committee” and substituting therefor the word “Institute”.
CLAUSE 24
THAT, clause 24 of the Bill be amended by deleting sub-clause (3).
CLAUSE 32
THAT, clause 32(2) of the Bill be amended in paragraph (d) by inserting the word “by” immediately after the word “appointed”.

THAT, clause 36 (1) of the Bill be amended by inserting the words “seek alternative dispute resolution mechanisms or” immediately after the word “may”.
CLAUSE 43
THAT, clause 43 of the Bill be amended — (a) in the marginal note by deleting the words “an association” and substituting therefor the words “a member”; (b) in sub-clause (1) — (i) by deleting paragraph (c); (ii) by deleting paragraph (e); and (iii) by deleting paragraph (f).
CLAUSE 45
THAT, clause 45 (2) of the Bill be amended by inserting the following new paragraphs immediately after paragraph (a) —
“(aa) procedure and fees for registration of members of the Institute;
(ab) a detailed scheme outlining procedures for qualification, issuing and revocation of practicing certificates under this Act;
(ac) a detailed scheme or code of conduct and ethics specifying acts that amount to professional misconduct in addition to those specified under this Act.”

LIMITATION OF DEBATE
The House resolved on Wednesday, February 2, 2022 as follows- Limitation of Debate on Committee Reports VII. THAT, each speech in a debate on Committee Reports (except for Reports of Audit Committees), including a Report of a Joint Committee of the Houses of Parliament or any other Report submitted to the House for which limitation of time has not been specified, shall be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Chairperson of the relevant Committee (if the Committee Report is not moved by the Chairperson of the relevant Committee) except for the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of ten (10) minutes each, and THAT ten (10) minutes before the expiry of the time, the Mover shall be called upon to reply; and further THAT priority in speaking shall be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in THAT order.

THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party shall be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen Minutes (15) each (if the Bill is not sponsored by either of them); and THAT priority in speaking shall be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in THAT order.
